1. About these terms
These Terms & Conditions ("Terms") govern your use of the KickFund website and application (the "Service"), operated by KickFund LLC ("KickFund," "we," "us"). By creating an account or making a contribution through the Service, you agree to these Terms.
2. The Service
KickFund is a fundraising platform for youth sports leagues. Donors contribute a per-point dollar amount tied to a team's game or competition results; team administrators post results; and the Service calculates points earned and the corresponding contribution. KickFund facilitates these contributions and related notifications. We are not a sports league, team, or charity and do not control how teams use funds raised. Contributions made through the Service are not charitable donations and are not tax-deductible.
3. Eligibility and accounts
You must be at least 18 years old to create an account or make a contribution. You are responsible for keeping your account credentials secure and for all activity under your account. Team administrators are responsible for the accuracy of the rosters, scores, and placements they enter.
4. Contributions
A contribution authorizes KickFund to charge your payment method for contributions calculated from team results, up to the per-game or per-competition cap shown when you set up the contribution. You may cancel a contribution at any time before the applicable points are earned, as described in our Refund & Cancellation Policy. KickFund LLC is the merchant of record for all contributions made through the Service: we charge your payment method, and the charge will appear on your statement under a KickFund descriptor. Payment processing is provided by Stripe and is subject to Stripe's terms. KickFund disburses funds raised to the designated team and is responsible for handling billing inquiries, refunds, and disputes relating to contributions.
5. Fees
KickFund may charge a platform fee on contributions and pass through standard payment-processing fees. All applicable fees are disclosed before you complete a contribution. See our Pricing page.
6. Referral rewards and promotional fee reductions
From time to time, KickFund may offer teams using the Service referral rewards or promotional reductions in platform fees ("fee holidays"), including promotions in which a referring team and a referred team may each receive a temporary reduction of the platform fee deducted from contributions to that team after qualifying conditions are met. The terms of any such promotion — including the amount of contributions eligible for a reduced or waived fee per participating team, the applicable fee rate, the qualifying conditions, and the period during which the reward is available — are those disclosed within the Service at the time the promotion is offered. Promotional terms are set by KickFund and may vary between promotions. KickFund may add, change, or discontinue promotions at any time, but a change or discontinuation will not reduce a reward a team has already earned, except as described below.
Referral rewards and promotional fee reductions have no cash value, are not redeemable for cash, and are not transferable or assignable. Contributions that are reversed, refunded, disputed, or charged back do not count toward a promotion's qualifying conditions, and a reward that depended on them may be adjusted or withdrawn accordingly. KickFund may also withhold, reduce, or revoke a referral reward or promotional fee reduction where it reasonably determines that the reward was obtained or used through abuse, fraud, self-referral, or referrals between teams or accounts under common ownership or control. Where a reward is withdrawn or revoked, KickFund may recover platform fees that were waived or reduced under it by applying the standard platform fee to, or deducting the amount from, funds subsequently disbursed to that team. Promotions affect only the platform fee deducted from a team's proceeds; they never increase the amount charged to the person making a contribution beyond the amount disclosed before the contribution is completed. Eligibility for and continued benefit of any referral reward is subject to compliance by the participating team and its administrators with these Terms and any additional promotion-specific terms disclosed in the Service.
7. Acceptable use
You agree not to misuse the Service, including by submitting false information, attempting to defraud donors or teams, interfering with the Service's operation, or using it for any unlawful purpose.
You also agree not to submit, post, or display content — including public display names — that is offensive, abusive, harassing, hateful, or otherwise objectionable. We have zero tolerance for objectionable content or abusive behavior. We may remove or hide any content, and suspend or remove any user, that violates this policy, with or without notice. Where the app offers it, you can report an objectionable name shown on a team's pages, or you can contact us (see Contact below). We review reports, and a name reported by multiple members may be hidden automatically.
8. Youth athlete information
Teams may add player information to track results. Publicly visible pages display only abbreviated player names to protect the privacy of minors. See our Privacy Policy for details.
9. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, KickFund is not liable for indirect, incidental, or consequential damages arising from your use of the Service. KickFund's total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total platform fees you paid to KickFund in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages; in those jurisdictions, our liability is limited to the greatest extent permitted by applicable law. Nothing in these Terms limits or excludes liability for gross negligence, willful misconduct, fraud, or any other liability that cannot be limited or excluded under applicable law.
10. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access for violations of these Terms or to comply with legal requirements.
11. Changes and governing law
We may update these Terms from time to time; material changes will be posted here with a new effective date. These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction, except where applicable law gives you the right to bring claims in the courts of your home state.
